Terms and Conditions
In short
- AttendTrack records attendance for organizations: clock-in and clock-out at approved places, leave, overtime and reports.
- Each organization is run by its owner, who is responsible for it. Its administrators manage its staff. Staff use the app to clock in and out.
- Your last clock-out of the day is the one that counts. A day not clocked out of by 12 AM is a missed clock-out: a normal day with no overtime.
- Use the app honestly: clock in and out only for yourself, only where you really are.
1. About AttendTrack
AttendTrack is a web application, installable on a phone, that organizations use to record their staff's attendance. It is operated by AttendTrack from Faridabad, Haryana, India ("AttendTrack", "we", "us").
With AttendTrack an organization can:
- let its staff clock in and clock out at its approved work locations, checked by the phone's location at that moment;
- work out each day: present, late, half day, early departure, absent, on leave, holiday or day off;
- count overtime, deductions and payable days, and see monthly reports;
- handle leave requests, allowances and holidays;
- send reminders and notices in the app, by notification and by email;
- keep a record of corrections and changes, with who made them and why.
These terms apply to everybody who uses AttendTrack: organization owners, administrators and staff.
2. Who is who
| Who | Who they are | What they are responsible for |
|---|---|---|
| AttendTrack | The provider of the app. | Running the app, keeping it secure, and handling the organization's data on its behalf as these terms and the Privacy Policy say. |
| Organization owner | The person who created the organization on AttendTrack. | The organization's account: who is added, what rules are set, how its data is used and kept, and its staff's information. The owner accepts these terms for the organization. |
| Administrators | People the organization makes administrators. | Managing staff for the organization: adding people, setting hours and locations, approving leave, correcting records with a reason, and acting on the owner's instructions. |
| Staff | People the organization adds to clock in and out. | Using their own account honestly and only for themselves. |
Responsibility runs in that order: AttendTrack to the organization, the organization's owner for the organization, its administrators for its staff. Questions from staff go first to their organization's administrator.
3. Accepting these terms
The organization's owner accepts these terms and the Privacy Policy for the organization when creating it on AttendTrack, by ticking the box on the sign-up form. When a new version is published, the owner is shown it and asked to accept it again at their next sign-in to the console; until then, the organization's staff keep working as before.
Administrators and staff do not tick anything; by using AttendTrack they use it under these terms, which the organization makes available to them through the links on every page.
We keep a record of each acceptance: who accepted, which version, and when.
4. Accounts and access
- Give accurate information, and keep it up to date.
- Keep your password to yourself. If somebody else may know it, change it, or ask your administrator to reset it. A password an administrator sets for you must be changed by you at your next sign-in.
- An email address belongs to one person and one organization on AttendTrack.
- The organization decides who has an account. An administrator can deactivate an account; a deactivated person cannot sign in or clock in, but their records are kept for the organization.
- Only the organization's owner can change who is an administrator, and the owner's own account is managed only by the owner.
5. Using AttendTrack properly
You agree not to:
- clock in or out for somebody else, or let somebody else use your account;
- fake your location, your device's clock, or a punch in any other way;
- try to get into an account, organization or data that is not yours, or to get around the app's checks and limits;
- attack, overload, copy or interfere with the app, or use it for anything unlawful.
The organization may treat a breach of these rules under its own policies. We may suspend access that breaks them (see section 11).
6. Clock-in, clock-out and overtime
Where you can clock in
- You clock in and out only at one of your organization's approved locations, within its set distance, with your phone's location turned on. Your location is read at that moment only — never in the background.
- You clock out at the location you clocked in at, unless your organization allows a different one.
- Without a connection, a clock-in or clock-out is saved on your phone and sent when the connection returns. The time recorded is the time you pressed the button, and the place must have been an approved one.
Your last clock-out counts
- You may clock out more than once in a day. The app asks you to confirm, and your last clock-out becomes the one that counts. Every clock-out is kept on record.
- Each day closes at 12 AM in your organization's time zone. A shift that ends after midnight closes halfway between its end and its next start — for 9 PM to 5 AM, at 1 PM the next day — so its morning clock-out still counts for that night.
- After you clocked in the day before, a punch between that day's close and four hours before your next start (12 AM to 5 AM for a 9 AM start) is refused: it is too late to be yesterday's clock-out and too early to be today's clock-in.
Overtime
- Overtime is counted only if your organization has it switched on and it is allowed for you.
- Your organization sets a grace period of 1 to 60 minutes after your office end time (15 minutes unless changed). Clocking out within it is leaving on time. Clocking out after it, and before the day closes, counts overtime from your exact office end time to your last clock-out.
- On a holiday or a weekly day off, all time worked counts as overtime of that kind, if overtime is allowed for you.
Reminders and notices
- Shortly after your office end time, if you are still clocked in, you are reminded to clock out.
- Notices about late arrival and early departure follow your organization's settings. An early departure is judged by your last clock-out, after the day closes, and notified the next morning.
- Notices appear in the app's Alerts; on your phone too, if you allow notifications. Not receiving one does not change the rules above.
7. Missed clock-outs
- If you clock in and have not clocked out by the time the day closes, the day has a missed clock-out.
- It counts as a normal working day up to your office end time, with no overtime, however late you actually stayed, and it is marked "Clock-out missing".
- Your organization sets how many missed clock-outs a month are allowed: Off (never counted), 0 (every one is a half day), or 1 to 7 (that many are normal days, each one after that is a half day). Unless changed, 3. The count starts again each month. On a holiday or day off, a missed clock-out is marked but not counted.
- The next morning you are told you missed your clock-out. If you worked overtime, tell your administrator the time you finished; only an administrator can change the day after that. Each morning, administrators also receive a list of the previous day's missed clock-outs.
8. Corrections by administrators
- An administrator may set or correct a day's clock-out, for example after a missed clock-out or when overtime was worked but not recorded. Every correction needs a written reason.
- Nothing is deleted: the original punches stay on record, and the correction is added beside them with who made it, when and why.
- The day, its overtime and any half day are worked out again from the corrected time. A corrected missed clock-out no longer counts toward the month's allowance.
- The employee is told the new time and the reason, and sees in their history who changed it.
- An administrator does not correct their own day while another administrator can do it. Days in a pay period the organization has locked cannot be corrected.
9. The organization's rules and records
Each organization chooses its own rules in AttendTrack — office hours, grace periods, late and early-departure limits, deductions, overtime, the missed clock-out allowance, working week, holidays, leave types and locations. AttendTrack applies the rules the organization has set. Days already recorded keep their figures until the organization replays them under new rules.
The organization, not AttendTrack, decides what it does with these records, including pay. Organizations should check their reports before relying on them for payroll or any other decision.
10. Availability
We work to keep AttendTrack available, accurate and secure, but it may sometimes be unavailable — for maintenance, updates, or problems with the internet or with the services we rely on. A clock-in or clock-out made without a connection is kept on the phone and sent later. We may add, change or remove features as the app develops.
11. Suspension and closing an account
- We may suspend an account or an organization that breaks these terms, puts others or the app at risk, or where the law requires it. Where we reasonably can, we will tell the organization's owner first.
- An organization's owner can ask us to close the organization and delete all of its data. How that works, and how long it takes, is in the Privacy Policy.
12. Responsibility and liability
AttendTrack is provided as it is and as available. To the extent the law allows, we are not liable for indirect or consequential loss — such as lost profit, or a pay decision made from a record — arising from use of the app or from it being unavailable. Nothing in these terms limits liability that cannot be limited by law.
Each organization is responsible for how it uses AttendTrack and for its dealings with its own staff.
13. Changes to these terms
We may update these terms as the app changes or as the law requires. The date at the top shows the version. When a new version needs agreeing to, the organization's owner is asked to accept it at their next sign-in to the console.
14. Governing law
These terms are governed by the laws of India. The courts at Faridabad, Haryana, have jurisdiction over any dispute about them.
